Aftermarket kits, who pays for the mistakes?

I'll leave names out.

We ordered $1500+ plus in aftermarket kits for our 7.4 engines. We ordered from an internet middleman, not the manufacturer.

We had a guaranteed delivery date ($115 in shipping) and an installation date set up with a mechanic around this delivery date. The mechanic is from out of town so he charges $75 for the travel.

Kits did not show up on time. Mechanic had to reschedule.

Kits make it and the mechanic starts the installation. 4 hours into the install he realizes he has the wrong kits. He calls the manufacturer who confirms he has the wrong kits. Kits are for a 90-94 engine, not our 95 engine.

Mechanic goes home. Manufactuer sends correct kits, charges $50 for shipping and wants the other kits sent back, another $50.

So at this point I am out $115 for the original shipping, which was not on time, $100 for the new shipping and $75 for one more travel time charge for the mechanic, or $290.

I have asked the middleman to refundreminburse me for these charges since he ordered the wrong kits. His reply is basically tough luck, you are on your own.

Anybody else had a similar experience? Makes me not want to add any aftermarket stuff to the boat again.
