I was surprised that I didn't see a post on this topic this morning.

I know a lot of us have been talking about law enforcement needing additional presence on the waterways, just saw this:

It’s a mixed bag, good to police those who can't seem to help themselves and get those drunks off the water, but just another hassle for those who can restrain themselves. I get boarded every time I go through the east river, it’s downright annoying, and I suppose it’s a small price to pay, but you can bet you will be boarded more often.
 
This kind of nonsense is exactly what we don't need. Checkpoints on rivers for drunks and expired flares will not stop some guy out on the bay in a go fast running 60mph while drunk at 5am or someone who goes seriously overloaded to fireworks with 1000 other boats that can't all be stopped.

Checkpoints are efficient for the cops. It gives them scalps to show to the media and that's exactly what they've wasted little time doing here.
 
good news as long as they stop the right people.
All you have to do is have a unmarked boat patrol through any cove on the weekend.
Take note which boats have alot of drinkers, then sit and wait for them to leave.
You never can tell from looking if Captain is drinking.
 
First, I don't believe in BUI. Now, let's level the playing field. You pull me over because my boat is bobing and weaving in the chop and I'm trying to keep it in the channel and I pop the meter, arrest me and I pay through the nose for legal fees etc..... Given the same circumstances and I blow 0.0, you pay to fill my boat with fuel from dead empty.

Check points just rub me the wrong way. They've had them in VA for some time now for alcohol. Now they have them for seatbelts. Where does it end.
 
OK, guys, I just don't get it. If the LE's do nothing people complain. If the LE's do something people complain. The only reason traffic laws have any effect at all on drivers is the fear of getting caught and having to pay a fine or go to jail. So, why is bosting so different? "OK, as long as they stop the right people." What? LE's aren't clairvoyant. They can only act on what they see or react to a situation.

So, is doing "something" better than nothing or should they just do nothing since, obviously, they just can't get it right anbd please everyone all the time?

And, yes, those "scalps" they waved on TV just might make some other guy go "holy s**t, those guys are getting serious" and amend their behavior. Second hand lessons are sometimes learned.

I m tired of having to deal with drunken idiots on the water! I agree that it can be a hassle but a few high profile checkpoints would send a message.

Same with lights and wakes.
 
Disagree completely Bob. First of all, I am not saying "do something". But if you are going to do something, don't do this.

You don't find dangerous operation in some river (which around here is a glorified name for a canal usually) where people are going 5mph.

It's nothing like enforcement on highways (not that I'm for checkpoints there either.) The Bay does not have roads. While they were doing this 1000 people left private docks for other private docks and went nowhere near this or any piece of water where this could be done. No message was delivered to the people who need to get one. I am not safer because of this.

It would have far more benefit for police to be out in unmarked boats, watching for truly dangerous or careless actions, and then stopping those people and seeing what the deal is. But they won't do that. I'm not talking 7mph in a 5 in some 13 foot Whaler. We all know what dangerous is - we see it from time to time, and nothing is done about it because no one who counts see it. Does anyone know anyone, or ever heard of anyone, who was ticketed for failure to give way when rules required it? It's obvious, ubiquitous, yet even that is never dealt with.

The fact that cops want to make a splash and do so cheaply and efficiently does not justify inconveniencing large numbers of innocent boaters.
 
I applaud the effort and hope it continues. Vehicle DWI checkpoints have been saving lives on the roads for years and I hope they do the same on the water.
Three people were named in the news report. A female, and a male on the North Shore. If the guy being taken out of the back of the car was that male then his demeanor on camera indicates that they got the right guy.
The Lindenhurst guy on the south shore had his boat confiscated because this was his second offense. I guess he didn't learn from the first. I wonder if there was n accident involve the first time around.
Knowing that there will be checkpoints will make some hesitate to indulge too much which is a good thing. For those that it doesn't stop from indulging that get caught it might not prevent them from doing it, but it will prevent them from doing any damage that particular day.
 
I know I won't be happy getting boarded, but if it puts fear into people, or gets the offenders off the water, I am all for it. To many people drive boats drunk, to many needless deaths.
 
The guy in Lindenhurst wasn't caught in a checkpoint. He was stopped for operating without lights according to Newsday. That's the kind of people they should stop and check out.

Alcohol can be a problem on the water, no argument.

But,

The killer is speed.

People have been drinking and enjoying themselves on the water since the beginning of time. A boat going 10 knots with a drunk captain is not going to hurt anyone. Can some people be a pita? Sure but the problem is speed. If they enforced speed, aggressive behavior in narrow channels and no wakes, they would catch their quota of drunks and leave the rest of us alone.

Them wearing bright red PFD's and pistol attached to their waist would be a dead give away.
I don't condone BUI nor do I like checkpoints. Follow the boat and wait till they break the law. Then hammer them.
 
In my little podunk city of Colonial Heights, VA they are giving awards to police officers who bag 100 DUI's. They even advertise it and heave accolades upon them like they were Roman Warriors. Of course we now have more dope running in and out of section 8 housing than you could shake a stick at. The local college is running amok more so now than in the past every homecoming weekend. They stole the effing license plates off my car from in front of a local restaurant to get MCV (Medical College of VA) frames. WTF!

I've lived in enough nasty places on this planet to see that you don't want to be guilty until proven innocent. If you cannot see your effing rights being stripped from you, you shouldn't be piloting a boat in the first place. You're effing blind.

If the conditions are rough as you described, why would anyone pull you over? Bobbing and weaving when its choppy is pretty normal. I am failing to see your logic. So, if you are stopped, asked to blow, and you blow a 0.0,you are not arrested, you are then going to sue for money because? (Im assuming that based on your "you pay to fill my boat with fuel from dead empty")

All I'm saying is I'm supposed to be innocent until proven guilty. It's what used to separate the US from the rest of the world.

I've seen these things all too often. They get written by people with no clue who want votes. They get executed by people with no training but get stiff nipples at the idea of unbridled power and get shoved on everybody which makes it impossible to enforce.

The government was designed to move at glacial speeds to preclude what it has become.

I'll give you an example with recoils of Virginia's lack of common sense.

We have a DUI problem in VA says a citizen.

No open (alcohol) container law in any vehicle; PERIOD, says the senate. That will solve our DUI problem...YAY says the citizen!!! HARUMPH says the Senate. That should get us another term in office.

1. UMMMM....Excuse me say the tour bus operators. You're telling me I cannot allow my non driving dead president paying customers to have adult beverages enroute to a Redskins game or a Nationals game. You're going to kill my business. You know....the business that pays taxes.

2. UMMMM....Excuse me say the restaurant owners. You have a law that allows citizens to remove a recorked bottle of wine from my establishment for consumption at a later time. My wine sales are going to go down. Most of the wine I sell is from Virginia. Do the math.

hmmmmm whisper the senators. as long as the driver of the tour bus is not drinking then that's OK. And as long as the recorked bottle is in the car's trunk...That's OK too.

HARUMPH says the Senate. That should get us another term in office.

3. UMMMMMMMMM Excuse me says the citizen who owns only an SUV........I have no trunk..........

ONE YEAR to change the efffed up law that if thought through would have been written correctly the first time.

The logic in filling my boat is there is no ramification to the person making the stop. It is no different than the loser pays rule that exists in British courts. Under the current scenarios in the states, probable cause in roadside checks is a fairy tale. Do you want that on the water?

As far as "sipping something while writing that", I honestly had to go check the time on the post. :D But I can tell you that if I had, I would not have been piloting a boat or driving a car.

I, like most conservatives, want the government to do three things. Protect my borders. It's done via a strong military. Design, build and maintain a transportation network to move product. (Note I did not say pay for it) Don't piss in my rivers.

Beyond that, get the farque out of my life.

I get your rant, believe me I do.

when I was in business, NYS DOT came out with new laws. Never really explained and left a rather large gray area. One of the laws was a limousine company would need to have a liquor license in order to serve scotch, whiskey, and vodka in the canters within the back of the limousine. Keep in mind, there is a partition that separates driver from passengers. Reason for the ban was that Limousine companies did not have a liquor license, so you could serve anything you wanted unless you had a liquor license. Well wait a minute. My customers were paying to go to a wedding in a limousine so they would not get a DWI. I had to explain this over the phone during the booking. I explained that the customers could bring what they wanted, we just couldnt not supply it.

The laws are written by money hungry theifs
