that property owner is gonna be pissed. you just removed his free cabana (complete with restroom, kitchen, and sleeping quarters).
 
It either needs to be totaled or untouched, anything in between generally sucks... it will never be the same, sorry for your situation, I know you would rather have it gone, mine got minor damage, just enough to cost me hundreds but not enough to put in a claim..... Dam Sandy!
 
I think many boat owners don't realize that fiberglass can easily be repaired... It's really not rocket science! Same with running gear... No big deal. Expensive, yes but it will be like new. Rub rail, gelcoat, stanchions, etc no big deal

Water damage is another matter if corrosion is not detected and addressed.

How could your insurance not cover property damage caused by the boat?

What s the point of having liability coverage?
 
So Travelers won't cover the damage but they'll hire a lawyer for you?

Do you have an umbrella policy?
 
don't have any recommendations but just want to say I hope things work out for you. really hearts to see this kind of stuff going on.

also if you don't mind me asking as i have Travelers as well, why wont the boat get fixed?

So if your boat gets loose during a storm and damages other boats or the marina dock, they don't cover these damages? That is ridiculous...
 
It almost doesn't make any sense. i got my insurance renewal yesterday and for the first time i actually read it. they advice the owners NOT to be on the boat in case of a storm so how come they tell you if you were on the boat...
I will bring the policy to my office tomorrow and post a copy of their "advise".
 
I had previously recommended Richard Roy who I used but he is in NJ.
No reason attorney has to be in the area, unless he is not licensed for NY, but I am sure he is.
He is good and he know's boats.
I think you want someone who know's boats and insurance claims and he has both.

Are all the companies claiming this is an act of god and therefore excluded?? In that case I don't se how a suit against you for an act of god would succeed.
 
Act of God. Just be glad you are not in a Wind vs. Water dispute with your underwriter. That is why the homeowner's policy will not address the damage to the house. Been there, done that. Grab the underwriter by the "short hairs" and don't let go. It took USAA five (5) years to learn how to properly adjust my loss post Katrina.
 
Bad, do you need a marine attorney? If so I have one to recommend that I've recommend to the marina and boat dealers when need be. What happens with the boat read it totaled or fixed?

Times like this makes me feel good I got out of boating and off the water. My old waterfront house got killed in Sandy and if I was still there I wouldn't be able to deal with it.
