Minor dock / pole work regulations?

I think the crane should stay all summer and the club could make some money on the dock fees.
 
Radiowaves, in regards to the free dock space, do yourselves a favor. Charge them $1/ft for the season and treat them just like any other customer in regards to lease agreement, etc.
 
If you can bring up this link to the LIYC, you can see a little strip of a dock to the top; this is called the signet dock. From the aerial view it is hard to see the 10’ wide area of water that runs along their bulkhead. There are other views that better shows what I have been posting about. This area belongs to the LIYC and we did try to bill them for the Jet Ski platform just like a member, but was considered easement and we were not allowed.

I think it was one of them, but that was not the one that I spoke with; they were to the west or right looking south. But two houses did make the call next to that dock. The woman in the house with the deck was yelling at the dock guys and then ran back in before I could try to reason with her.

To be fair, I can understand their concern that there is an 80 slip yacht club next to their house and we can create some distraction within their surroundings. The barge did pull in Sunday afternoon to begin work on Monday, not on the weekend. It’s ironic that one of the families were even summer members for a while.

We did have issues with both families using that side of the dock because of possible future land rights, so they are most likely upset at us. We were not saying that they could not use the space, just let it be known in that it does belong to the LIYC. Somehow they got a ruling that it is easement and they have right to it. But further legal investigating on our part proves that incorrect if they put a structure I.e. a Jet Ski platform, but we are not going to pursue it at this time.

We were there for 50 years and before any of the houses were there. We are a Yacht Club and need to do repairs from time to time and as long as we are within our legal right we should not have to be questioned by each time we are doing work.

I have not found out exactly when the work will begin, so the barge and crane sits.

I'm not a lawyer but if you knowingly allow someone to use your property it becomes there right to always continue to do so after x amount of time. If you don't have legal representation on this issue you may want to consider it.

Besides, as the major jerks they are I'd love to see you go get em! :)

I believe the easement should allow them access across your 10 feet of property to their own but not the right to permanent use of the water over the club's property. I would push that one because I agree that over time it will be much more difficult to assert your property rights if they do something more aggressive or if the club decides to use that dock side for something.

I have an extra boat if you want to block their egress and push the issue;-)
 
On one of the aerial photos (the last one on marnias.com) I see a jetski platform with two jetskis with red seats. Is that the platform in question? If so, it looks like it's tied to their bulkhead. Are you saying LIYC actually owns the land underneath? It looks like a very nice spot for a boat ramp...that'll teach them!

Folks are going to complain no matter what happens. We actually lease our land from the village so the local politicians and some tax payers think they own the place. The ruling is village residents are allowed on our land but not on the deck or docks. With four miles of riverfront, it aggrevates me that people feel the need to come into our place and enjoy the view. It's more frustrating when some village residents say "we should take over that place and make it a restaurant". What they don't understand is according to our lease, all permanent structures must remain. However, the tool sheds are two "shipping containers", the docks float and the clubhouse is classified as a "temporary structure". When built, we would have had to go 80' to find bedrock for the footings. Instead, they poured pods and put in three trailers/modules stitched together at the seams. It looks great but is classified as "temporary" in order to get the building permits. In the end, it works better for us.

Sorry for going off topic, I just wanted to let you know there are other clubs dealing with a few jerks. Luckily, we have no neighbors...all parks.

Yes the LIYC does own the space between the dock and their bulkhead. So even though they are attached to their bulkhead, they are technically on our property. We had once wanted to use that area to line up small sail boats the kids use for the JR sailing program and free of the other side of the finger dock for transients. We also had other plans but not anymore.

Well then, I'd pursue a cheap rental agreement, complete with the appropriate INSURANCE requirements. As far as I know, easements are for temporary egress in and out. For instance, if they actually do have an easement, they can bring a boat in to do seawall work....temporarily. Another example, if you have a sewer line running through your property, the local town/utility company usually has an easement to do work as needed w/o your permission. However, they can't build a shack on it.

I'd talk to the club's lawyer and at least attempt to get a cheap rental agreement. heck, you could do that with other neighbors as well to help remove your disorderly neighbor problem. As of now, it looks like they are trespassing...easement or not.
 
I can see why they would take the position they are taking and why they will probably put up a fight over it. Their properties are less valuable if they are responsible for the maintenace of their bulkhead but don't have any water rights.

However, that's the way they bought their house and the club should assert its rights to the property. I agree with Walshie, ultimately you give them a cheap rental agreement but they won't go for that until they have no choice.

I too stayed at a Holiday Inn once :) :)
 
If anyone can provide any additional DEC Permit facilitators it would be appreciated. We have a permit now for most general work, but will expire in a couple of months.

We will contact the one that Mark (Boatbasin) recommended, but I would like to give a couple more choices to the board.

There are not a lot of good choices but if you need another couple of expediters for comparison, then the other two I would recommend would be Roy Hage, En-consultants 283-6360 and Chuck Bowman, Land Use, 727-2400

Chuck Bowman is very good but his prices have become insane.

Having used all three, I would still recommend Joe Enrico as he is simply the best and easiest to work with. You will not regret using him.

I can’t believe it is a year later and we are back to the same issue.... Getting permits….. I am going to present yet again the information that Mark give me to the Board.

Brad.......If you need a company to expedite getting your permits....let me know. I just went thru it 2 weeks ago to reface my bulkhead....they got my permits in just a few weeks.
