WTF is up with NYS Sales Tax???

About 4 years ago I got a letter from the sales tax division telling me they had no record that I paid sales tax for the "new" 2004 Silverton I have. Since the boat was bought "new" and from a NY state dealer, I didn't get it, so I sent them a copy of my bill of sale.

Get a letter in the mail today, stating the same.

What is up with NYS sales tax division, could they be that screwed up!!!!

Anyone else get a letter ????

Normally you pay sales tax when you register the boat. Is it registered in NYS?

The letter did state something about documentation (i guess my recent renewal). Boat is registered and documented, has been from day 1.
 
If the dealer collected it, they should have sent it in! If the dealer collected it they screwed you and did not send it in. Hope they are still in business....

PS, I would have never gotten the registration and sales tax stamp if it was not paid.
 
Boatbum may be on to something!. If they didn't pay and didn't provide the state with a sales tax bond, you may have a bit of a problem.
 
The first registration should have an indication that you paid the taxes. If I am not mistaken it says this is your receipt keep it in a safe place?

Walter, I just got a similar letter from them. I sent them my registration as proof I paid taxes. You are right - you can't get a registration without paying taxes.

Make sure you request written confirmation that the case is closed - I got mine a couple of weeks after I sent the proof.

It's incredible how one NYS department has absolutely no communication with the other one...
 
The first year reg will have the tax amount added to the reg cost and will state the total amount on the reg.
 
No letter here. Stinks theft are confused but I am happy they are trying to go after this.
Hurt when I paid sales tax on my boat bought in Nj but glad I did.
Just wish everyone did because you there are people out there who don't pay!
 
Wonder if they will try this with cars.....motorhomes....motorcycles....next ???? They must need extra holiday bonus $$$$..........WTF ???
 
I bet Walters not the only one from the anchorage that received the letter. I received the same letter a few years ago. Basically either the marina gave ur information to the STATE or they had someone at the the marina and they just send the letter to everyone... ITs pretty crazy in this day and time.

NYS is crying the blues big time. Interesting. I thought the sales tax was a county related tax. How much of the registration sales tax goes to the state?

This is all probably the result of an audit trying to blame boaters for not paying taxes. The problem is they went after registrants, not inhabitants that register their boats elsewhere or with LLCs.

So Walt do you display your regy numbers and sticker on the hull or do you hide behind the documentation deal? Could be someone ratted you out because you did not have the regy stamp on the hull?
 
He has reggy on hull but I think it is expired. So that may be why they came after you.
 
In NY, you don't display registration numbers if the boat is documented. You only
display the sticker.

My boat has a valid sticker, whoever came down my dock was obviously too lazy to walk a couple of feet further to see my sticker.

Apparently they don't communicate with each other in the same department, I did this 3 or 4 years ago.
 
Welcome to my world. Of all taxing authorities NYS can be the most difficult to deal with. If you have proof dont take any crap from them.
 
How many of those do they mail out and folks just pay without question thinking it is some other form of tax?
 
As I said before, though it seems they are doing double work, I am happy to see they are pro-active to nail the people who don't pay.

I remember meeting a guy who says he had his boat registered in NC so he would avoid paying NYS sales tax.
But he boats in NY and docks his boat for the summer in NY.
He felt he shouldn't have to pay, but upon further review of the rules, he should.
It's these kind of people that are taking tax dollars out of our pockets.
If you boat in NY and want to keep your boat in NY then you will need to pay our sales tax!
 
I feel the exact opposite about it. If there is a loop hole you can exploit to avoid paying any kind of tax (legally) then I say go for it. Maybe if nearly 60% of my income did not go towards some form of tax I would feel different.

edit:
I forgot to add that I also think it is a huge waste of taxpayer dollars even having a division doing this. The amount they recoup likely is a lot less than the cost. If they created a tax free haven for boaters they could likely make back more than double in revenue from sales taxes on consumables which would employ more people and create more income tax.
