Don't get me started on the ones that have foreign registry and stay here. You should see what it looks like down here in Florida.

Key word be legally.
To do this legally you can't stay in NYS waters for more than 90 days in a row. Now, one can argue how do they know you didn't leave. What if you stay for 90 days then go to CT for a few then return. So yes, there is a loophole here. I would keep very good records if I was going to exploit that loophole.
 
That is my point. How much does it cost the state to keep track of it? Easy enough to take a trip every 90 days. It is not like you have to go several hundred miles to get out of the state. An overnight at a marina 4 times a year? And as long as I am there I can fill up on diesel too (which is more lost revenue). And the sales tax they could collect via staying at the marina. But the money spent to keep tabs on those boats, the ones that did not pay, is probably higher for one month than they could take in during one year. If anything I would think you would be complaining about them wasting your money on it. If you had $10mil a year in boats that did not pay sales tax when purchased, at 6% you could collect $600k. How much do you think they are spending a year statewide to enforce it and keep tabs on boats to see if they are there more than three months?

Only if boat stays in NY for more than 90 days, then it is considered a NY boat.

Whether they make money collecting it or not, it has to be enforced to a point.
If there was no attempt to collect, then everyone would do it and the loss would be even more.

Like I said, there are loopholes and they can be exploited. It's like everything tax wise, where there is a will there is a way.
But the 90 day rule is the law.
 
then I couldnt store it over winter in NY would have to spend my money somewhere else.

I checked this out because I was looking to avoid sales tax on future purchases.

If your legal residence was not in NY when you purchased the boat, no sales tax.

If your legal residence was not in NY, and you are not living in NY and buy a boat while not in NY, No Sales Tax.

If your a legal resident of NY, have a house in FL, buy a boat, then bring the boat to NY, you will be charged sales tax on the difference of what you paid in FL to what the NY sales tax would be.
 
Deleware doesn't seem to concerned about it and they seem to have bout the same rule. It is cutting off you nose to pite your face. Its like they are saying, come for a visit, just don't sty very long, we don't need your money that bad. When you purchase a boat new that is one thing for the sales tax. But when your buying a used boat that has already been taxed on the new sale it is like a double tax. And if your visiting for longer than three months they want to try to add sales tax for hat too?
 
Thats the way it went for me when I purchased my M/H in Florida.....I paid Florida sales tax. Then when I registered it in NYS....I had to make up the difference in the sales tax. It was the worst $10K I ever spent....and its not deductable. :(

They get you either way............
 
So why did you register it in NYS? We just moved all our stuff down to Fl..
 
Because right now Im still living in NYS...... I'll be transfering the M/H and cars down to our new place in Florida in the fall. I didn't want to play that game .....and get caught with my pants down.
 
I hate the way our Gov't has only become some kind of money generating machine, 98% only concerned about how and where it can get the next buck an unconcerned about things that are important to its constiuancy.
 
I just received a letter from NY looking for sales tax. Though living in NY I've sailed exclusively in Maryland for 10 years.
EXCEPT, this summer for a visit to LI Sound. The boat is documented, and registered in Maryland which required payment of sales tax.
Likely, tax revenuers spied the boat or the marina is required to report newly arriving boats.

I thought I wouldn't have to visit the boat so soon after putting the cover on to get the documents.

Technically your boat is suppose to be registered in ny and pay ny tax. You are a resident of ny. I think you may have a tough fight. Your permanent residency is ny. Worst case scenario you will get a credit for Maryland tax paid.
 
I don't think that is true. You pay sales tax where the boat is slipped. Example, I had 179 to leave Florida before paying sales tax. My boat is in VA now and I would owe sales tax there (and property tax if it was staying). How would the state you reside in even know if you owned a boat if it was never registered there?

I live in NY but keep my boat in New Jersey. I paid New Jersey sales tax like the New Jersey rules say.

New York sent me a letter asking me for Sales and Use Tax on the boat.

Sorry, boat isn't in NY for the required period so no soup for you.

I didn't quite word it that way in my response letter, but that was 3 years ago and I haven't heard from them after that.
 
NY wants you to pay for everything you buy out of state, if you are a NY resident. On the NY tax form, there is a place to list your out of state purchases, including internet purchases, where you did not pay NYS sales taxes so that you can be assessed the tax. I have also heard that they used to record NYS license plates at the malls in New Jersey and send letters asking for sales tax...
