I am usually pretty well covered with safety equipment. But you guys have given me another thought. From now on, I will keep my scuba pony bottle with a regulator connected, along with mask & fins very handy. It would take me no time to get under a capsized boat as long as the equipment is handy.

Wish I could click the "Like" Button, but we are not in Facebook...Being an advanced PADI / SSI diver myself, ok, well a few years back, I agree having this aboard would be helpful, but in this case, I am not sure what could have helped. As everyone else said.. SAD....
 
So the father of the little girl, Victoria was just on tv. He wants a law to prevent this from happening again. Thy are calling it Victorias law.

They want licensing of boaters. So I do agree with this but not sure how it would of helped here. Their kid died because they along with all the other adults on that boat were stupid. They all ignored the obvious.
 
You can't legislate stupid. I feel terrible for these families but how would a law change anything. If the owner and the guy running the boat that night thought 27 persons was acceptable I don't see how a license would change that. People drive drunk even though it's against the law. Vast majority of dwi's have a drivers license but that still didn't stop them from driving drunk.sooner or later we are all responsible for our decisions and actions.
 
Figures. They are stupid and incompetent and want to screw up the lives of others to excuse their own stupidity and incompetence. Sorry, but my sympathy for them just ended. Frankly, hearing that the woman couldn't swim and had to be saved by her son pretty much killed the sympathy thing, because an adult with no physical handicap who can't swim is basically useless to begin with. There's simply no excuse for it.

Just what the sh!t politicians need, a way to pass some pointless law that does nothing, for example requires people to take a course that teaches only the most basic boating facts and in no way avoids anyone having this very accident. And they can wave the flag and say they solved a problem that will remain unsolved, because it's unsolvable. Certainly nothing in the boating safety course addresses anything like this, and the only law that could be passed would require everyone to take that course.
 
If you can't swim, why don't you know where the life jackets are if your not wearing one? When do people start taking responsiblility for their own actions?
 
When new people come on my boat I always ask if they can swim? I show them where life jackets are. And I fill them in on what can and cannot go into a vacuflush.
 
Since the biggest problem was the children being locked in the cabin, the main lesson I learned is to make sure to have an escape plan or just leave it open.
 
While arguments can certainly be made that licensing might not have prevented this tragedy, and you can't legislate stupid, it is still a good idea and might prevent some future incidents.
I am always amazed at just how many people are running around out there that don't have the faintest idea about even the most basic rules of safety. Yet, if they have the cash, they are cruising. Some have been boating for many years and consider themselves "experienced".
How many times have you heard how "experienced" the skipper of that 34' Silverton was?
Licensing could certainly address that.
While it would be difficult to test the operation of all boats on the water, it isn't unreasonable to require that persons operating a boat over a certain size be required to demonstrate their skills before being allowed to run around out there.
Maybe they could issue a general license after written test for operators of boats under 21', and require a test on the water from 21 - 27, another from 28 - 35, etc..
Licensing fees could cover the cost of the tests.
A license could also be revoked for violations much the same way as a Driver License is, and operating with a revocation could be grounds for arrest.
It wouldn't solve all of the problems, but it might slow things down and send a wake up call to many who think that "the other guy" is the problem.
Unfortunatley there is no real way to measure the lives that are saved by enforcement of rules and good common sense.
 
Although boat operators are not licensed in NY, §49-2 (3)of the Navigaton Law of New York gives the court the power to suspend a persons privelege to operate a vessel and his boat registration if he is convicted of BWI. The suspension will be for a minimum of six months for a first offense and up to twenty four months for repeat offenders. Of course, enforcement is another issue.

6 months for the first offense, sounds reasonable. Second offense, should be game over, revoke boat operations for ever!!!!
 
John, I don't argue that a comprehensive licensing program with on the water tests wouldn't improve things - but it's simply not happening. The public infrastructure to make it happen isn't there and isn't likely to be created. And I really don't want to pay for it. Ultimately this guy hurt himself and his passengers so it's their problem. I'm OK with dodging the yahoos and teaching my daughters to do the same.

Frankly, if you want to invest public funds to fix a problem with poor judgement by vehicle operators, you would not start with boats, you would start with cars. Many more die every day because some people with driver's licenses should not actually even be allowed to operate bicycles or golf carts. The only reason they can is the absurdly trivial amount of testing that is done to hand out that little card we all have.

When that one gets fixed, then society should worry about boats.

We need a law to create and enforce capacity limits for all boats, even though all those who were on this particular boat swear it wasn't overloaded?

Does this clown even know what he is suggesting? I'm sure the CG would love to make loading and stability recommendations for... every recreational boat that's ever been made? Or just new ones at a time when no one is actually buying any and the companies are all going bankrupt?

I was out yesterday with 11 people on my boat.
Had a hard time getting the trim tabs to balance the boat becuase people were moving around (I told them to stop).
But at one point I keeled over good to starboard, immediate pull back on throttles, yelled to stay in 1 spot.
Mind you, I am a 40' boat with 11 people.
The 27 people Captain is a idiot, case closed. Not sure a plate stamped with max cap 10 persons is going to help.
You can't legislate ignorance or stupidity, the legislators themselves already have the market cornered on that!

Yeah, could of but I was fine with them aboard.
Besides I needed some manpower to free my tiny anchor that was holding my boat and walters!
Like 70,000 lbs on it!
I also got caught in this ahole's wake.
Guy was plowing water in state channel, so I go to pass him to port.
All of sudden he decides to go fast to not let me pass and that is when it happened.
Real piece of work.
Then he slows down to lindy cut too early.
Then he picks up again but again is plowing water.
I kept my distance, played it safe and plowed behind him.
Not sure what he was thinking as he was not on plane.
He pulled straight past the anchorage, not sure where he was headed, but the admiral thinks he is on S dock there.
There is no courtesy on the bay on the weekend!
